Part II: Legal Provisions on Travel Mediation
Below we give you some information about our mediation activities. That is, we explain what we do to bring about the contracts you want with tour operators or service providers.
Scope of these terms and conditions; division into Parts A, B and C
1.1. The following terms and conditions govern the legally different types of mediation of travel services and package tours with regard to the rights and obligations of the customer and the intermediary depending on the type of travel service mediated. A distinction must be made between:
- a) the mediation of a package tour, hereinafter referred to as "travel mediation", the intermediary in this context "travel agent"; the provisions can be found in Part A.
- b) the mediation of linked travel arrangements; the provisions can be found in Part B.
- c) the mediation of an individual travel service; the provisions can be found in Part C.
Part A: Provisions for the Mediation of Package Tours pursuant to § 651v BGB
Applicable when the travel agent hands out the package tour form.
1. Conclusion of Contract, Statutory Provisions
1.1. The travel mediation contract is concluded upon acceptance of the mediation order. Order and acceptance do not require any specific form. In the case of electronic communication, the intermediary shall confirm receipt immediately (not yet an acceptance confirmation).
1.2. Rights and obligations arise from the contractual agreements, these GTC and the statutory provisions (§§ 651a ff BGB, Art. 250ff. EGBGB, §§ 675, 631 ff. BGB).
1.3. For rights/obligations towards the mediated tour operator, only its travel or business terms and conditions apply.
2. Payments, Customer Declarations
2.1. Payments before the end of the trip only with an effective customer funds protection contract and handover of the security certificate.
2.2. The travel agent is deemed authorised to accept notifications of defects and forward them to the tour operator. Direct declaration to the tour guide is recommended.
3. General Contractual Obligations, Information, Notices
3.1. Best possible advice and handover of documents after confirmation by the organiser.
3.2. Liability for correct selection of the information source. Without a special information contract, no liability is assumed for the accuracy of information provided (§ 675 (2) BGB).
3.3. No obligation to determine the cheapest provider without explicit agreement (best price guarantees remain unaffected).
3.4. No guarantee of prices/availability without explicit agreement.
3.5. Special requests are only forwarded. Fulfilment is the responsibility of the organiser (after its confirmation).
4. Entry Regulations and Visas
4.1. Taking over registrations for electronic entry permits does not, without agreement, create an obligation to provide further visa information.
4.2. No obligation to obtain visas without an explicit order (if necessary, against reimbursement of expenses/remuneration).
4.3. No liability for non-issuance or delayed access to visas, unless the intermediary has culpably caused this.
5. Reimbursement of Expenses, Remuneration, Collection
5.1. The intermediary may demand payments as an authorised collection agent or in its own right (§ 669 BGB).
5.2. This applies correspondingly to cancellation fees.
5.3. Offsetting or retention by the customer against claims against the service provider is excluded unless the intermediary has culpably co-caused the claims.
6. Air Transport Services
6.1. Obligation to inform about the identity of the operating air carrier (EU Regulation No. 2111/2005).
6.2. The statutory provisions apply (LuftVG, Warsaw/Montreal Convention, Regulation (EC) No. 261/2004, Regulation (EC) No. 1107/2006).
7. Documents & 8. Obligations to Cooperate
7.1. Obligation to check the handed-over documents for accuracy and completeness.
8.1. The customer must immediately notify recognisable errors in the mediation activity.
8.2. If notification is omitted, claims lapse unless the customer was not at fault or it concerns damages arising from injury to life, body or health (in case of intent/negligence) or the violation of essential obligations. Liability for booking errors under § 651x BGB remains unaffected.
9. Complaints & 10. Insurance
9. The intermediary accepts notifications of defects but has no obligation to provide legal advice vis-à-vis the organiser.
10. Reference to travel cancellation, travel interruption and international health insurance. The intermediary is not liable for benefit refusals by the insurance due to effective insurance conditions (e.g. pre-existing conditions), unless it has provided false information.
11. Liability of the Travel Agent
11.1. No liability for defects/damages in connection with the mediated travel service (except in the case of an explicit assurance that deviates from the service description).
11.2. Own liability under § 651x BGB or culpable breach of duty remains unaffected.
12. Consumer Dispute Resolution
The travel agent does not participate in voluntary consumer dispute resolution.
Part B: Provisions for the Mediation of Linked Travel Arrangements pursuant to § 651w BGB
Applicable when the form for linked travel arrangements is handed out.
1. Conclusion of Contract & 2. Payments
1.1. Conclusion of contract for the mediation of linked travel arrangements.
2.1. Payments only if reimbursement is secured in the event of the intermediary's insolvency (insolvency insurance pursuant to § 651w (3) BGB).
3. General Obligations & 4. Entry/Visas
Essentially correspond to Part A. The intermediary informs about entry/visas only upon explicit order or in special recognisable circumstances. No special research obligation.
5. Air Transport & 6. Collection
Correspond to Part A.
7. Remuneration Claims of the Intermediary
7.1. Airline prices generally do not include commission. Remuneration is made through service fees (according to notice/agreement).
7.3. The claim to service fees remains in the event of service disruptions (rebooking, cancellation, etc.) unless the customer has a claim for damages due to defects in advice/mediation.
8. Documents & 9. Obligations to Cooperate
Correspond to Part A. Deadlines for claims against the service provider are generally not preserved by asserting them with the intermediary (Section 10.1).
10. Complaints & 11. Insurance
Restricted to providing known information/addresses. No obligation to advise on deadlines/claim requirements. Insurance references correspond to Part A.
12. Liability & 13. Consumer Dispute Resolution
No liability for defects in the travel service. Own liability under § 651w (4) BGB, § 651x BGB and culpable breach of duty remains unaffected. No participation in voluntary consumer dispute resolution.
Part C: Provisions for the Mediation of Individual Travel Services
Applicable when the service is neither part of a package tour nor linked travel arrangements (no form required).
The provisions in Part C (conclusion of contract, information, entry/visas, air transport, collection, remuneration claims, documents, obligations to cooperate, complaints, insurance, liability, consumer dispute resolution) correspond in structure and content essentially to the provisions of Part B, adapted to the mediation of pure individual services (e.g. hotel only, flight only).
Special feature of Part C: The liability of the intermediary is limited to the culpable violation of intermediary duties (Section 11.2).
